Colorado District Court Latest to Dismiss Industry Lawsuit against Building Updates

A Colorado district court has thrown out a corporate-backed lawsuit that tried to block Denver's building energy code, which pushes buildings toward electric equipment like heat pumps instead of gas furnaces and water heaters. The plaintiffs, including landlord associations, the National Propane Gas Association, and the Colorado Restaurant Association, argued that a federal law called the Energy Policy and Conservation Act (EPCA) overrides Denver's authority to set these rules. The judge disagreed and sided with the city and the Sierra Club, which had joined the case to defend the code.

Denver's energy code, passed in 2023, aims to cut air pollution and lower energy bills by encouraging buildings to switch from fossil fuel heating to electric systems. The city has dealt with severe air quality problems this year, at times ranking among the worst in the world due to wildfire smoke, and supporters say the code helps buildings handle extreme heat while cutting energy use and shielding owners from swings in fossil fuel prices.
