Southern California clean-heat rule survives key legal challenge

A federal appeals court has upheld a Southern California air quality rule that targets pollution from gas-fueled boilers, water heaters, and similar equipment. The U.S. Ninth Circuit Court of Appeals rejected a legal challenge from gas-appliance makers and contractor groups, keeping in place a regulation that took effect in January. The rule, set by the South Coast Air Quality Management District, gradually cuts smog-forming nitrogen oxide emissions from more than 1 million gas appliances across Los Angeles, Orange, Riverside, and San Bernardino counties. It does not ban gas equipment outright, but it does require aging or worn-out units to be replaced with zero-emission alternatives, with the rules eventually covering more types of equipment in existing buildings by 2033.

For homeowners, the immediate impact is on residential pool heaters and tankless water heaters, which fall under the new emissions limits. If you own one of these in the covered Southern California counties, replacement rules will eventually apply as the equipment reaches a certain age or the end of its useful life. The policy's backers hope it will also push manufacturers to ramp up production of heat pumps and other electric alternatives, which could lower prices for these appliances more broadly, even outside California.

The fight isn't fully over. Opponents, led by appliance maker Rinnai America, can still ask the court to reconsider its ruling. Meanwhile, regulators are drafting a separate set of rules for larger commercial and industrial systems, expected to go before the air district's board by the end of the year.
