First Solar sues JA Solar and American Panel Solutions over TOPCon patents

October 5, 2026 · PV Magazine USA · Score: 52

First Solar has sued JA Solar, a Chinese solar manufacturer, along with American Panel Solutions (AMPS), a U.S. distributor owned by Corning, over patent infringement. The case, filed in federal court in Delaware, centers on a manufacturing patent for TOPCon solar cells, a technology that has largely replaced older PERC panel designs because it converts more sunlight into electricity. First Solar says it holds the patent through 2030 and wants both money damages and a court order blocking the import, assembly, and sale of the disputed panels in the U.S.

AMPS runs a solar panel assembly plant in Arizona that was previously linked to JA Solar. By suing both the panel maker and its U.S. distribution partner, First Solar appears to be trying to cut off the technology at multiple points in the supply chain, not just at the factory overseas.

This is part of a broader pattern: First Solar has filed similar patent cases against other major panel makers, including JinkoSolar, Canadian Solar, Trina Solar, and T1 Energy. For homeowners, this is mostly background noise for now — a legal fight between manufacturers, not a change to any rebate program or tax credit. But if the case succeeds and leads to an injunction, it could affect which brands of solar panels are available or how they're priced in the U.S. market down the road, since TOPCon technology is now common across many panel brands sold to homeowners.
