Appeal Halts Public Lands Data Center in Nevada Before Construction Begins

September 1, 2026 · CleanTechnica · Score: 9

A federal appeals panel has stopped construction on a large data center planned near Boulder City, Nevada, before any building began. The Townsite project would have been the first data center built on federal public land in the country. The Center for Biological Diversity, the Sierra Club's Toiyabe Chapter, and local Boulder City residents filed an appeal against it, and the Interior Board of Land Appeals granted a stay while it reviews the case.

The board found the challengers are likely to win their argument that the project was approved without a proper environmental review specific to a data center. Instead, officials had relied on an older approval process that had been set up for a solar project at the same site. The stay blocks the project from moving forward while the legal challenge continues.

For homeowners, this doesn't change any rebate or upgrade program directly, but it's a sign of how fast data centers are being proposed near residential areas, and how much scrutiny they're starting to draw. Data centers use large amounts of electricity, and where they get built and how they're powered can affect local grid demand and rates over time. The Bureau of Land Management is reviewing other data center proposals on public land elsewhere in Nevada, and this ruling means those projects will now face more rigorous environmental review before they can proceed. If you live near a proposed data center site, this case may be worth watching, since it could set a precedent for how these projects are reviewed elsewhere.
